12.3 The Disciplinary Committee
The university has a specially established disciplinary committee. The Vice-Chancellor is chair of the committee. There is also a representative of the teachers, as well as a member well versed in law, a judge. Through the different student unions at the university, the students have the right to be represented by two members, plus replacements. The disciplinary committee should make sure that a matter referred to it is investigated carefully. The committee should give the student concerned by the matter a chance to respond before the committee. The student also has the right to be present when others are speaking before the committee, unless there are particular reasons against it. In accordance with the regulations in section 9 of the Administrative Procedures Act, the student also has the right to hire a solicitor or counsel for his or her contacts with the committee. Any costs for solicitor or counsel are not met by the university.
Which measures can be taken?
The measures available are a warning or a suspension from studies. A suspension can last a maximum of six months. A decision about suspension means that the student, during the suspension, is not allowed to take part in any kind of teaching or examination and is not allowed to be in laboratories, library, etc.
A decision about suspension should be implemented immediately, unless stated otherwise in the decision.
Remember:
A period of suspension is considered as cessation of studies as regards the Government sponsored financial support for students. A suspended student is therefore generally liable to repay financial support that has been paid out for the time the student is suspended. The university notifies the CSN when someone has been suspended.
Appealing against decisions by the disciplinary committee
Decisions concerning suspension may be appealed against with the county administrative court of Västerbotten. The appeal (see section 1.3 about appeals) should be submitted to the university. While waiting for the court to assess the appeal, the party appealing may request that the court makes an interim decision that the suspension should not be implemented. The court will make a particular decision in this question upon request.
